The Romanian government has implemented RO e-Transport, a digital system designed to monitor the transport of goods with high fiscal risk. This initiative, enforced by Government Emergency Ordinance no. 129/2024, aims to reduce tax evasion and increase transparency in commercial logistics.

E-transport is a declaration made according to the legal provisions in Romania, in the case of transport of goods with high fiscal risk on the territory of Romania.

This is an electronic system designed to monitor the transport of goods and reduce tax evasion.

The law is regulated by the National Tax Administration Agency (ANAF), which is also responsible for controls and fines for those who do not comply.

Each such transport has a unique identification code, called the UIT code, which the driver must have before entering Romania.

In some cases, it is also mandatory to transmit the GPS position of the transport to the National Tax Administration Agency (ANAF).

What are the affected assets by e-Transport?

The goods affected by the RO e-Transport system are those included on the official list of high fiscal risk products according to ANAF, as follows:

  1. Vegetables, edible plants, roots and tubers, falling under CN codes 0701 to 0714 inclusive;
  2. Edible fruits; peels of citrus fruits or melons, falling under CN codes 0801 to 0814 inclusive;
  3. Beverages, alcoholic liquids and vinegar, falling under CN codes 2201 to 2208 inclusive;
  4. Salt; sulphur; earths and stones; plaster, lime and cement, falling under CN codes 2505 and 2517;
  5. Articles of apparel and clothing accessories, knitted or crocheted, falling under CN codes 6101 to 6117 inclusive;
  6. Articles of apparel and clothing accessories, other than knitted or crocheted, falling under CN codes 6201 to 6212 inclusive and 6214 to 6217 inclusive;
  7. Footwear, gaiters and similar items; parts of such articles, falling under CN codes 6401 to 6405 inclusive;
  8. Iron and steel, falling under CN codes 7213 and 7214.

Which Transports Are Subject to RO e-Transport?

The requirement applies to the following transport types:

  • National transport (origin and destination within Romania)
  • Exports and intra-community deliveries (origin in Romania)
  • Imports and intra-community acquisitions (destination in Romania)

When is GPS transmission mandatory?

GPS data must be transmitted to ANAF if all the following conditions apply:

  • The vehicle has a maximum permissible weight of at least 2.5 tons
  • The goods exceed either:
    • 500 kg in total weight
    • 10,000 RON in total value (excluding VAT)

Who is responsible for declaring the transport?

The responsibility for declaring the transport in the RO e-Transport system depends on the type of operation:

  • For imports and exports: The person or company named as the importer or exporter in the customs documents must declare the transport.
  • For goods bought from the EU: The Romanian buyer must make the declaration.
  • For goods sold to the EU: The Romanian seller is responsible for the declaration.
  • For goods in transit through Romania: The person or company storing or regrouping the goods in Romania must declare the transport.

Important: The transport company or driver is not responsible for generating the transport code (UIT). They only need to make sure they have the code before the journey starts.

UIT Code – Key Facts

It is a 16-character code generated via the RO e-Transport platform. This code is uniquely assigned to each individual transport operation.

Validity:

  • 5 calendar days for national transports
  • 15 calendar days for intra-community acquisitions

The UIT code can be generated up to 3 days before the start of the transport.

Penalties for Non-Compliance

For Legal Entities:

  • Fines ranging from RON 20,000 to RON 100,000.
  • Confiscation of undeclared goods.

For Natural Persons (e.g., Drivers):

  • Fines ranging from RON 10,000 to RON 50,000.
  • Drivers without a valid Unique Transport Code (UIT) or GPS tracking face fines between RON 5,000 and RON 10,000.

GPS Tracking Requirements:

  • As of April 1, 2025, transport operators must ensure the transfer of current positioning data of the transport vehicle throughout the transport route.
  • Failure to comply results in fines:
    • RON 10,000 to RON 50,000 for natural persons.
    • RON 20,000 to RON 100,000 for legal entities.
